Thank you for the advice and suggestions unfortunately none of those worked. I believe there was something fundamentally wrong with my joomla core files which were preventing the update from triggering.
I fixed the issue by doing the following steps so anyone else can try this as well as a last resort.
1. Back up to the database on the broken site.
2. Create a new subdomain and make a clean Joomla! 3.10.12 installation
When making the installation use the same database prefix.
3.Overwrite your database with your backup
4.My particular site was using fabrik so I installed fabrik on the new clean installation (unzip in root)
5. Change the connection string in Fabrik
6. Check everything works
7. Run the joomla 4 updater
